Rationale

• RAJUK is in the process of designing version 2.0 of its ECP System. This version will enable direct electronic submittal of plans and other design documents by professionals; facilitate more thorough plan checks; make inspection procedures more efficient; and create a One Stop Shop to streamline the process of obtaining approvals from other competent authorities.
• The Parties have an interest in confirming that the design professionals listed on a construction permit application are members of IEB with 05 (five) years’ of experience working under a professional design engineer / project engineer and will be qualified through interview by a committee of 03 (three) members from panel of experts for enrollment in BPERB in order to maintain the integrity, honor and dignity of the profession, protection of public safety through safe design which is defined as the integration of hazard analysis and risk assessment methods in the design and engineering stages and the taking of the actions necessary so that the risks of injury or damage are at an acceptable level and thus improving the quality of building design in Dhaka city. After getting enrollment, these engineers will be required to submit 30 (thirty) hours of Continuing Professional Development (CPD) training record on Bangladesh National Building Code (BNBC). Dhaka Mohanagar Imarat Nirman Bidhimala (DMINB) and IEB Code of Ethics & Rules of Ethics of BPERB every year and also they shall be required to get their Professional Engineer (PEng) Registration within 03 (three) years’ from the date of recommendation for continuation of their enrolment.
• IEB members are regulated by a Constitution, By-Laws and IEB Code of Ethics & Rules of Ethics of BPERB to ensure that they render engineering services competently & responsibly. They shall uphold paramount safety and welfare of the public and follow principles of environment & sustainability with minimal adverse effect on the environment & health.
• RAJUK’s Building Construction Rules, 2008 (“Rules”), require that engineers be members of the IEB. The Rules further require that design engineers be recognized as Professional Engineers by the Board of Professional Engineers of Bangladesh (BPERB) to sign design documents and be enlisted with RAJUK.
• Presently, RAJUK’s construction permitting system does not automatically confirm that engineers have the required qualifications. The Parties want to create this functionality in the ECP System.
• The Parties wish to work together, and with the BPERB, to ensure adequate testing and qualifications of RAJUK enlisted engineers.

Area of Collaboration

• RAJUK will endeavor its best to:
• Use international best practices to upgrade ECP System, including to add the functionality to access the database of BPERB-qualified IEB members. This database will be used to automatically check that the engineers involved in applications for land use clearance or construction permits or supervising construction are, in fact, members in good standing with the IEB. The database further will be used to confirm that engineers submitting signed design documents are recognized as Professional Engineers by the BPERB.
• Work with IEB and the BPERB to review and update the RAJUK enlistment system with consideration of the following:
• Only engineers who have passed a RAJUK-enlistment exam and who become Structural Engineers may submit design documents to RAJUK.
• The RAJUK-enlistment exam will be conducted annually.
• Within three years after becoming a RAJUK-enlisted engineer, engineers must also pass the BPERB PEng. exam. If the PEng. exam is not passed within three years, the RAJUK enlistment will be suspended until the PEng. exam is passed.

• BPERB-IEB will endeavor its best to:
• Design a purposeful Application Programming Interface (API) enabling the automated retrieval of membership details, status and BPERB qualification of a given IEB member from IEB’s membership database by the ECP System.
• Ensure that every IEB professional is adequately informed about new regulations and ECP System requirements, including how to request an electronic certificate from RAJUK, install such an electronic certificate on his/her own computer, and submit design documents.
• Ensure that every IEB professional is adequately informed on his/her responsibility toward a given construction project team in case that professional is selected as project team leader by the project owner.
• Work with RAJUK during the roll-out and use of the ECP System to continue to improve the operation and functionality of the system and the experience for applicants.
• Work with RAJUK and the BPERB to review and update the RAJUK enlistment system with consideration of the following:
• Only engineers who have passed a RAJUK-enlistment exam may submit design documents to RAJUK.
• The RAJUK-enlistment exam will be conducted annually by the competent authority entrusted.
• Within three years after becoming a RAJUK-enlisted engineer, engineers must also pass the BPERB PEng exam. If the PEng exam is not passed within three years, the RAJUK enlistment will be suspended until the PEng exam is passed.
• Require supervising structural engineers to check structural elements (foundation, columns, beams, and slabs) of the building during construction to ensure compliance with the design and to upload the supervision report and photographs to the ECP System. Include these provisions in the Code of Ethics with disciplinary consequences for failure to comply.

• ইঞ্জিনিয়ার্স ইনস্টিটিউশন হইতে নির্মাণ বিধিমালার সংশ্লিষ্ট দায়িত্ব পালনে ডিজাইন ও সুপারভিশন কাজে ০৫ (পাঁচ) বছরের অভিজ্ঞতা সম্পন্ন দক্ষ সিভিল/স্ট্রাকচারাল এবং অন্যান্য প্রকৌশলীদের তালিকা প্রস্তুত করা এবং আইইবি’র মাধ্যমে তা রাজউকে প্রেরণ করা।
• নিবন্ধনে আগ্রহী প্রকৌশলীদের নির্ধারিত ফরম-এ সংশ্লিষ্ট কর্তৃপক্ষের নিকট আবেদন করিতে হইবে এবং আবেদনপত্রের জন্য নির্দিষ্ট ফি প্রদান করিতে হইবে।
• নিবন্ধীকরণে আগ্রহী প্রকৌশলীদের “রাজউক ও আইইবি সমঝোতা স্মারক” অনুযায়ী ক) বিএনবিসি, খ) মহানগর ইমারত নির্মাণ বিধিমালা, গ) আইইবি কোড অফ ইথিক্স এবং রুলস অব ইথিক্স অব বিপিইআরবি বিষয়ে নূন্যতম ০৫ (পাঁচ) দিনের (৩০ ঘন্টার) প্রশিক্ষণের প্রমাণাদি সহ রেকর্ড জমা দিতে হইবে।
• যে সকল প্রকৌশলী পিইঞ্জধারী নন, সেসব প্রকৌশলীদের মূল্যায়নের জন্য নিবন্ধন তালিকায় অন্তর্ভূক্ত করার লক্ষ্যে নিবন্ধন প্রক্রিয়ায় বিপিইআরবি’র পক্ষে রেজিস্ট্রার অফিস প্রয়োজনীয় প্রশিক্ষণের বিষয়সহ যোগ্যতা ও অভিজ্ঞতার রেকর্ড যাচাই-বাছাই করিবে। বিপিইআরবি-রেজিস্ট্রার সাচিবিক দায়িত্ব পালন করিবে। আগ্রহী সদস্যদের যোগ্যতা যাচাই কল্পে প্রতি বছরে একবার ১০০ (একশত) নম্বরের  ০২ (দুই) ঘন্টা সময়ের নির্বাচনী পরীক্ষার আয়োজন করিবে এবং নির্বাচনী পরীক্ষায় উত্তীর্ণের জন্য সর্বনিম্ন ৫০ (পঞ্চাশ) নম্বর অর্জন করিতে হইবে।
• বিপিইআরবি’র চেয়ারম্যান মহোদয়, নির্বাচনী এবং মৌখিক পরীক্ষার জন্য বিপিইআরবি’র প্রফেশনাল ইঞ্জিনিয়ার এসেসরগণের তালিকা হইতে একটি প্যানেল গঠন করিবেন। “রাজউক ও আইইবি সমঝোতা স্মারক” অনুযায়ী উক্ত প্যানেল হইতে প্রয়োজনীয় প্রতি গ্রুপে ০৩ (তিন) সদস্যের কমিটি লিখিত ও মৌখিক পরীক্ষা নিবেন।
• লিখিত পরীক্ষায় যোগ্য উত্তীর্ণ প্রার্থীদেরকে উপরিল্লিখিত ০৩ (তিন) সদস্যের কমিটি’র (যাহারা প্রফেশনাল ইঞ্জিনিয়ারদের মধ্য হইতে মনোনীত হইবেন) নিকট মৌখিক পরীক্ষায় অবতীর্ণ হইতে হইবে এবং উত্তীর্ণ হওয়া সাপেক্ষে নির্বাচন ও তালিকাভূক্তির সুপারিশ করা হইবে। বিপিইআরবি’র রেজিস্ট্রার সাচিবিক দায়িত্ব পালন করিবে এবং উত্তীর্ণ ও সুপারিশকৃত প্রার্থীদের নাম আইইবি-এর মাধ্যমে রাজউক-এ প্রেরণ করিবে।
• লিখিত ও মৌখিক পরীক্ষায় উত্তীর্ণ প্রার্থীদের সনদপত্র প্রতি বছর নবায়নের ভিত্তিতে প্রদান করা হইবে এবং নবায়নের জন্য বিপিইআরবি-কে একটি নির্দিষ্ট ফি প্রদান করিতে হইবে।
• “রাজউক ও আইইবি সমঝোতা স্মারক”, বিএনবিসি, নির্মাণ বিধিমালা এবং আইইবিই কোড অব ইথিক্স অনুযায়ী ডিজাইন, তত্ত্বাবধান, তদারকি, রিপোর্টিং ইত্যাদি দায়িত্ব পালনে রাজউক নিবন্ধীকরণের লক্ষ্যে সকল প্রকৌশলীকে পিইঞ্জধারী হইতে হইবে অথবা পিইঞ্জ না থাকিলে সর্বাধিক ০৩ (তিন) বছরের মধ্যে পিইঞ্জ অর্জন করিতে হইবে।
• যে সকল প্রকৌশলী পিইঞ্জধারী নন, সেসব প্রকৌশলীদের নিবন্ধন তালিকায় নাম অব্যাহত রাখিতে নিবন্ধীকৃত প্রকৌশলীদের “রাজউক ও আইইবি সমঝোতা স্মারক” অনুযায়ী ক) বিএনবিসি, খ) মহানগর ইমারত নির্মাণ বিধিমালা, গ) আইইবি কোড অফ ইথিক্স এবং রুলস অব ইথিক্স অব বিপিইআরবি বিষয়ে প্রতি বছর নূন্যতম ০৫ (পাঁচ) দিনের (৩০ ঘন্টার) প্রশিক্ষণের প্রমাণাদি এবং বার্ষিক কর্মকান্ড সম্পাদনের রিপোর্ট কর্তৃপক্ষ এবং বিপিইআরবি’র নিকট নবায়নের জন্য রেকর্ডসহ জমা দিতে হইবে। নবায়নের জন্য বিপিইআরবি-কে একটি নির্দিষ্ট ফি প্রদান করিতে হইবে।
• পিইঞ্জ ধারী প্রকৌশলীগণ সরাসরি নিবন্ধনের জন্য আবেদন করিতে পারিবেন এবং নিবন্ধনের জন্য নির্ধারিত ফি প্রদান করিবেন এবং নিবন্ধীকৃত প্রকৌশলীদের বিএনবিসি, নির্মাণ বিধিমালা, আইইবি কোড অফ কনডাক্ট, সেইফ ডিজাইন এবং সুপারভিশন ও নির্মাণ সেইফটি বিষয়ে প্রতি বছর নূন্যতম ০৫ (পাঁচ) দিনের (৩০ ঘন্টার) প্রশিক্ষণের প্রমাণাদি এবং বার্ষিক কর্মকান্ড সম্পাদনের রিপোর্ট কর্তৃপক্ষ এবং বিপিইআরবি’র নিকট নবায়নের জন্য রেকর্ডসহ জমা দিতে হইবে। নবায়নের জন্য বিপিইআরবি-কে একটি নির্দিষ্ট বার্ষিক ফি প্রদান করিতে হইবে।
